Candidate Consent to Personal Data Processing and Terms of Cooperation with the Agency
1. Personal Data Processing
I consent to providing Agency “BAIA 2” with the following personal data for the purpose of employment assistance:
· full name
· date of birth
· personal identification number
· contact telephone numbers
· email address
· social media profile address
· place of residence
· personal photograph
· work experience
· reference from a previous employer
· medical certificate concerning my health condition
· criminal record certificate
· marital status, including the number and ages of my children
I agree that the above data may be retained by the recruitment specialists of Agency “BAIA 2” until I submit a written request to terminate cooperation with the Agency, including where I have been employed once or multiple times through the assistance of the Agency.
I authorize the Agency’s recruitment specialists to access the above personal data and entrust them with its use solely during the period of their employment with Agency “BAIA 2”. They may not use my data after leaving Agency “BAIA 2”, including while working for another agency.
I consent to the publication of my candidate photo profile on the website of Agency “BAIA 2”, www.hrbaia.ge, containing the following information:
· name
· age
· work experience
· requested minimum remuneration
· my photograph
Only the above information will be visible to users of the website. Where a client is interested in my candidacy, direct contact with me will be available to the client only through the Agency and with my express consent.
I also consent, during the period in which my photo profile remains in the Agency’s database — from the moment of registration until I submit a written request to cancel it — to receiving messages from the Agency:
· through social media
· by email
· on my mobile telephone by SMS or other electronic message
Such messages may concern vacancies and any related updates and, if I begin a trial period or employment, the progress of the trial period and/or any outstanding amounts due to be transferred.
2. Employment-Related Terms
I acknowledge and agree that registration with the Agency does not constitute a 100% guarantee that I will find employment within several days, weeks, months, or any other defined period.
The final selection is made by the client, namely the person who will pay the salary from their own funds at the end of each month. The Agency’s obligation toward me is limited to offering me active vacancies received by the Agency through telephone calls, email, or social media.
Where the list contains a vacancy acceptable to me, I express my interest through the Agency’s website or communicate the vacancy identification code by email, social media, or telephone. The relevant Agency employee then sends my application profile directly to the client or discusses my candidacy with the client by telephone.
I am required to attend an interview with the client only where the client expresses interest in my candidacy based on the information shown in my profile on the Agency’s website. I understand that other candidates may also be invited. Following an individual interview — at the client’s home, remotely, or at the Agency’s office — the client decides which candidate to invite for a trial period.
Accordingly, I understand that applying to the Agency increases the likelihood of finding employment to a certain extent, but does not create a 100% guarantee. I fully understand and accept this condition.
I have also been informed that where I confirm my agreement to attend an interview for a vacancy proposed by the Agency but fail to attend without a valid reason, the Agency may automatically cancel my profile after three such failures to appear.
If, after completion of the trial period, I am not employed, I agree to pay the Agency 25% of the amount earned during the trial period, but only if the client has actually paid that amount to me. The relevant amount must be transferred to the designated bank account of LLC Agency “BAIA 2”.
If I am employed, I agree, as an employed candidate, to pay the Agency 50% of my first month’s salary.
I have also been informed and agree that if I am employed again through the Agency, whether during the term of the agreement or after its expiration, I must again pay the Agency 50% of my first month’s remuneration.
I have been warned that if I am employed or receive payment for a paid trial period and fail to pay the Agency the applicable percentage, the Agency may bring a civil claim before the court. The candidate may also be placed on the Agency website’s “blacklist”, which may be visible to users of the website. As a job-seeking candidate, I consent to this condition.
The candidate is prohibited, after interviewing with a client, from establishing an employment relationship or beginning work with that client by bypassing the Agency, and from offering the specific vacancy to relatives, friends, or other persons by bypassing the Agency.
If an Agency representative discovers such conduct, the candidate must ensure payment to the Agency of an amount equal to 50% of the employee’s first month’s salary. Otherwise, the candidate has been warned that a penalty of GEL 500 will apply and agrees to this condition.
I have also been warned and agree that where, after an interview or contact with a specific client through Agency “BAIA 2”, the client does not hire me but later recommends my candidacy to a relative, friend, employee, or any other acquaintance, and I begin work for that person at any time, such employment will be deemed employment arranged through the Agency because my connection with the potential employer arose through the Agency.
In such a case, I agree to pay the Agency its standard commission of 50% of the first month’s remuneration. Concealing this fact from the Agency will be treated as a breach of the terms of cooperation and will result in a penalty of GEL 500.
The candidate has been warned that submitting forged reference letters or any other forged documentation to the Agency may give rise to liability under criminal law.
3. Time Limits and Grounds for Cancelling the Candidate Profile
1. the candidate’s written request
2. a reasoned decision of the Agency
3. expiry of the one-year archival retention period following cancellation of the data
